🏹 Martraw Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Martraw ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App is operated by N.THING Inc. ("Company," "we," "us," or "our"), a company incorporated in South Korea.

2. Description of Service

Martraw is a location-based mobile application that gamifies grocery shopping experiences. The App allows users to:

Discover and visit "hunting grounds" (real-world stores)
Scan product barcodes to collect virtual "food" items
Recognize food items via photo and scan receipts
Complete missions and earn rewards
Compete on store-specific leaderboards
Track walking activity during shopping trips

            Important: Martraw requires physical presence at real-world retail locations. The App is designed to enhance, not replace, your actual grocery shopping experience.
        

3. Eligibility

The App is available to users of all ages (rated 4+)
Users under 13 (or applicable age of consent in your jurisdiction) should use the App under parental supervision
By using the App, you represent that you have the legal capacity to enter into these Terms

4. User Accounts and Profiles

No registration or account creation is required
Profiles are created locally on your device
You are responsible for maintaining the confidentiality of your device
Profile data may be synced to cloud services for leaderboard functionality

5. User Conduct

You agree NOT to:

Use the App in any way that violates applicable laws or regulations
Interfere with or disrupt the App or servers
Attempt to gain unauthorized access to any part of the App
Use cheats, exploits, automation software, or any unauthorized third-party tools
Harass, abuse, or harm other users
Use the App while driving or operating machinery
Trespass on private property to access "hunting grounds"
Create offensive, inappropriate, or misleading profile names
Manipulate leaderboards or game data

6. Safety Disclaimer

            ⚠️ Safety First:
            Always be aware of your surroundings when using the App
Do not use the App while driving, cycling, or operating vehicles
Respect store policies and staff instructions
Do not trespass or enter restricted areas
The Company is not responsible for any injuries or accidents that occur while using the App

        

7. Intellectual Property

The App and its original content, features, and functionality are owned by N.THING Inc.
The App is protected by copyright, trademark, and other intellectual property laws
You may not copy, modify, distribute, sell, or lease any part of the App
The "Martraw" name, logo, and related marks are trademarks of N.THING Inc.

8. Third-Party Services

The App may use third-party services including:

Apple HealthKit for step tracking
Apple MapKit for location services
Firebase for analytics and cloud services
Anthropic Claude API for AI-powered food recognition and receipt analysis

Your use of these services is subject to their respective terms and privacy policies.

9. Virtual Items and Currency

The App may include virtual items (badges, food items) and virtual currency (gold, XP)
Virtual items have no real-world monetary value
Virtual items cannot be exchanged for real currency or goods
We reserve the right to modify, remove, or reset virtual items at any time

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability or fitness for a particular purpose
Accuracy, reliability, or availability of the App
Uninterrupted or error-free operation
Security of transmitted information

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, N.THING INC. SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, or goodwill
Any damages resulting from your use or inability to use the App
Any personal injury or property damage related to your use of the App

12. Indemnification

You agree to indemnify and hold harmless N.THING Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason
You may stop using the App at any time by uninstalling it
Upon termination, your right to use the App will immediately cease

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in the App. Continued use of the App after changes constitutes acceptance of the modified Terms.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of South Korea
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Korea
For users in other jurisdictions, local consumer protection laws may apply

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
